1. INTRODUCTION

These Terms and Conditions (“Terms”) govern your access to and use of the eskedi go platform, including its website, mobile application, and related services (collectively, the “Platform”).

eskedi go is operated by ESKEDI-CO LTD, a company duly incorporated under the laws of the Federal Republic of Nigeria. eskedi go is a trademarked product of ESKEDI-CO LTD, with its trademark registered under the Commercial Law Department of the Federal Ministry of Industry, Trade and Investment.

eskedi go is a multi-vendor marketplace that enables users to browse, order, and pay for goods and services offered by independent merchants. The Platform allows users to combine products from multiple merchants into a single cart and complete checkout through a unified system.

By accessing or using eskedi go, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the Platform immediately.

2. ELIGIBILITY AND ACCOUNT REGISTRATION

To use eskedi go, you must have the legal capacity to enter into binding agreements under applicable law. You may be required to create an account using your email address or phone number.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. eskedi go reserves the right to suspend or terminate accounts suspected of fraudulent activity, misuse, or violation of these Terms.

eskedi go may also restrict access to certain features or services at its discretion.

3. PLATFORM ROLE AND MERCHANT RELATIONSHIP

eskedi go is a technology platform owned and operated by ESKEDI-CO LTD. It facilitates transactions between users and independent third-party merchants.

eskedi go does not own, manufacture, sell, or control any products or services listed by merchants. Each merchant operates independently and is solely responsible for pricing, product accuracy, availability, quality, and fulfilment of orders.

Any purchase made through eskedi go creates a direct transaction between the user and the relevant merchant(s), while eskedi go provides the technological infrastructure for the transaction.

4. ORDERS AND ACCEPTANCE

When you place an order, you are making an offer to purchase goods or services from one or more merchants.

Orders are only confirmed when accepted by the relevant merchant(s). eskedi go does not guarantee acceptance of any order, and merchants may reject or cancel orders due to stock availability, pricing errors, operational limitations, or other valid reasons.

Where an order includes multiple merchants, each merchant is responsible only for fulfilling their portion of the order.

5. MULTI-MERCHANT CART FUNCTIONALITY

eskedi go allows users to add products from multiple merchants into a single cart, where applicable under the shopping category. Although checkout is unified, fulfilment remains distributed across merchants.

Users acknowledge that:

  • Orders may be split between multiple merchants

  • Delivery or pickup timelines may differ per merchant

  • Each merchant fulfils only their assigned portion of the order

  • eskedi go is not responsible for merchant-level fulfilment delays or failures

6. ORDER FULFILMENT OPTIONS

Depending on merchant availability, users may select different fulfilment options at checkout, including preparing an order immediately, preparing it at a scheduled time, or shopping in-store personally where items are reserved for in-person selection.

Certain merchants may also support after-hours pickup or special collection arrangements. Availability of these options is determined solely by the merchant.

7. PRICING AND PAYMENTS

All prices displayed on eskedi go are set by merchants and may change without prior notice.

eskedi go supports multiple payment methods, including debit/credit cards, bank transfers, wallet balances, reward tokens (where applicable), and payment requests sent to third parties.

Payments must be completed before orders are processed. eskedi go does not store full card details and relies on secure third-party payment processors.

If a payment fails or is not confirmed, the order may be cancelled or not processed.

8. WALLET AND REWARD TOKENS

eskedi go may offer a wallet system that allows users to store funds for use within the Platform. Wallet funds are strictly for transactions within eskedi go and are not generally withdrawable unless expressly stated.

Users may also earn reward tokens based on eligible transactions. Reward tokens are promotional in nature, have no cash value unless explicitly stated, and may be modified, suspended, or revoked at eskedi go’s discretion, including in cases of refunds, cancellations, or suspected fraud.

9. PAYMENT REQUEST TO A FRIEND

eskedi go allows users to send secure payment requests to third parties via digital links or email. The recipient may complete payment on behalf of the user.

eskedi go is not responsible for failed payments, incorrect recipient details, or refusal by the recipient to complete payment.

10. PICKUP, DELIVERY, AND AUTHORIZATION

Users may choose delivery or pickup depending on merchant availability. For pickup orders, a secure pickup code may be required before release of goods.

Users may authorise third-party collection using a valid pickup code. Once a pickup code is successfully used, the order is considered fulfilled, and eskedi go shall not be responsible for any disputes arising after release of the goods.

Some merchants may offer after-hours pickup; however, this is not guaranteed and depends entirely on merchant availability.

11. SCAN & GO FEATURE

Where available, eskedi go provides a Scan & Go feature allowing users to scan items in participating physical stores and complete payment through the Platform.

Users are required to ensure all items are properly scanned before exiting the store. Any attempt to bypass scanning or payment may result in account suspension, legal action, or permanent restriction from the Platform.

12. CUSTOMER NOTES AND INSTRUCTIONS

Users may provide instructions or notes to merchants during checkout. These may include packaging preferences, preparation instructions, or delivery details.

Merchants may attempt to follow such instructions but are not legally obligated to do so where it is operationally impractical or impossible.

13. VENDOR RESPONSIBILITY

All merchants on eskedi go operate independently. They are solely responsible for their products, services, pricing accuracy, availability, order fulfilment, and compliance with applicable laws.

eskedi go does not guarantee merchant performance and shall not be held liable for merchant-related issues.

14. REFUNDS AND CANCELLATIONS

Refunds and cancellations are subject to merchant policies and eskedi go operational rules. Certain items or services may be non-refundable depending on their nature or merchant policy.

15. PROHIBITED CONDUCT

Users agree not to misuse the Platform. This includes fraudulent activity, providing false information, interfering with platform operations, abusing merchants or other users, or attempting to bypass payment systems.

eskedi go reserves the right to suspend or permanently terminate accounts involved in prohibited conduct.

16. INTELLECTUAL PROPERTY

All intellectual property rights in eskedi go, including its software, design, branding, trademarks, and content, are owned by ESKEDI-CO LTD or its licensors.

eskedi go is a registered trademark of ESKEDI-CO LTD under the Commercial Law Department of the Federal Ministry of Industry, Trade and Investment.

No part of the Platform may be copied, reproduced, or distributed without prior written consent.

17. LIMITATION OF LIABILITY

eskedi go shall not be liable for indirect, incidental, or consequential damages arising from the use of the Platform. This includes, but is not limited to, merchant delays, product quality issues, delivery failures, or service interruptions beyond our control.

eskedi go’s responsibility is limited to providing the Platform infrastructure connecting users and merchants.

18. TERMINATION

eskedi go may suspend or terminate access to the Platform at any time if a user violates these Terms, engages in unlawful activity, or poses risk to the Platform or other users.

Users may discontinue use of the Platform at any time.

19. CHANGES TO TERMS

eskedi go may update these Terms from time to time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.

20. GOVERNING LAW

These Terms are governed by the laws of the Federal Republic of Nigeria.
